Former police officer’s death sentence commuted to 40 years

putrajaya: Two former police officers escaped from the gallows yesterday after a three-person federal court panel reduced their death sentences imposed for the murder of an Indonesian mechanic 18 years ago to 40 years in prison.

The panel, comprising Chief Justice Tun Tengku Maimun Tuan Mat and Federal Court Justices Datuk Nordin Hassan and Datuk Vazir Alam Maidin Meera, concluded that Airyas is based on the amendments to the death penalty and natural life imprisonment sentences. Granted the request for retrial by Mr. Yahya and Mr. Saiful Azlan Shah Abdullah (interim jurisdiction of the federal court). Federal Court) Act of 2023.

The two men have been in prison for 18 years and three months, with their sentences starting from the date of their arrest on January 22, 2006.

The court earlier rejected a request by Deputy Public Prosecutor Tetralina Ahmed Fawzi to uphold the death sentences of two former police officers, saying their cases were rare.

She told the court that the deceased, Yusrizal Yusuf, 38, was under their full control at all times from the time of his arrest until his death.

Tetralina said Yusrizal was shot “execution style” when he was taken to a square on KM22 Kuala Lumpur-Kual Selangor-Batu Aran road in Gombak, Selangor. Handcuffed and told to kneel, Aylias stood in front of the deceased while Saiful Azlan fired three shots into his head at close range.

However, lawyer Mohammad Fadli Sutris, who represents Airias and Saiful Azlan, said that Airias suffers from a chronic illness and is confined to a wheelchair, while Saiful Azlan has been hospitalized several times. He asked the court to give his client a second chance, saying he is in the ICU.

He said Airyas, who had been with the Royal Malaysian Police since 1976, and Saiful Azlan, who had been with the police since 1982, regretted their actions and asked the court for mercy because they wanted to see their families. He said he asked for it. – Bernama
